These Terms of Service (“Terms”) govern your use of themoderncreator.com and any related programs, webinars, courses, or coaching services (collectively, the “Services”), operated by Modern Creator Coaching LLC. By using the Site or Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Services or enter into a purchase.

2. Services Description

Modern Creator Coaching LLC provides business education, coaching, and webinars for photographers, including but not limited to webinars, an eight-week beta course, and an ongoing coaching program. Specific offer details, pricing, and inclusions are described at the point of registration/purchase.

3. Payments & Refunds

  • Payments are processed through Stripe. By making a purchase, you also agree to Stripe’s applicable terms.
  • All fees are due in full as stated at checkout.
  • All sales are final. We do not offer refunds under any circumstances. If you believe extraordinary circumstances apply to your situation, you may submit a request to hello@themoderncreator.com. Any review of such a request is entirely at our discretion, and submitting a request does not guarantee a refund will be issued.

4. Intellectual Property

All content on the Site and within our programs — including the PROS framework, course materials, templates, videos, and branding — is owned by Modern Creator Coaching LLC and protected by copyright and other intellectual property laws. You may not copy, resell, distribute, or repurpose this content without written permission.

5. License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use purchased content for your own personal or business use. You may not share login credentials or resell access once accounts are introduced.

6. User Conduct

You agree not to:

  • Use the Site or Services for unlawful purposes
  • Attempt to gain unauthorized access to our systems
  • Reproduce, distribute, or publicly share paid content
  • Harass, abuse, or harm other participants or staff

7. No Guarantee of Results

Coaching and educational content are provided for informational purposes. We do not guarantee specific financial results, income, or business outcomes. Individual results vary based on effort, market conditions, and other factors outside our control.

8. Disclaimer of Warranties

The Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Modern Creator Coaching LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

10. Termination

We reserve the right to suspend or terminate access to the Services for violation of these Terms, without refund, at our discretion.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Florida, unless otherwise required by applicable consumer protection law.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
